The American Kitchen Cabinet Manufacturers Association urged its members to write to the U.S. Trade Representative, requesting to extend the Section 301 ruling on China’s exports and maintain the current level of tariffs on China’s imports into the United States.
In 2021, the American Kitchen Cabinet Alliance (AKCA) submitted a formal accusation against BGI Group to the US Customs and Border Protection. On January 27th, 2022, the United States ruled that American cabinet warehouse companies evaded anti-dumping duties (AD) and countervailing duties (CVD). It is reported that American cabinet warehouse companies may have to pay up to 83% tariff. However, on June 7, the US Customs and Border Protection overturned this ruling because of the lack of sufficient evidence. The American kitchen cabinet industry is undoubtedly very disappointed with this decision. According to Article 301 of the Trade Law of 1974 "On China’s Behaviors, Policies and Practices in Technology Transfer, Intellectual Property and Innovation", the wooden cabinets, cabinets and accessories imported by the United States from China are currently subject to a tariff of 25%.
On May 3, 2022, the Office of the US Trade Representative initiated the legal procedures required before the fourth anniversary of the implementation of these tariffs. The Office of the US Trade Representative is conducting a review to decide whether to extend the tariff of Section 301 beyond the upcoming four-year anniversary.
After receiving the extension request, the office of the US Trade Representative will enter the "second stage" of the review. During this period, stakeholders will have the opportunity to comment on the effectiveness of measures, alternative measures and the impact of such measures on the US economy.
