In order to fully develop judicial democracy, promote judicial justice in an all-round way, ensure citizens to participate in judicial activities according to law, and ensure the smooth development of people’s jurors’ work, according to the Law of People’s Republic of China (PRC) on People’s Jurors and the Measures for the Selection of People’s Jurors, Shangsi County Judicial Bureau, Shangsi County People’s Court and Shangsi County Public Security Bureau jointly decided to openly select people’s jurors for the whole county, and the matters concerning the selection of people’s jurors in Shangsi County in 2020 are hereby announced as follows:
I. Number of elected members
This time, 390 people’s jury candidates will be openly selected to the public (312 candidates will be selected by random selection, and the remaining 78 candidates will be selected by individual application and organization recommendation).
Second, the selection conditions
(1) A citizen serving as a people’s juror shall meet the following conditions:
1. Have People’s Republic of China (PRC) nationality and support the Constitution of People’s Republic of China (PRC);
2. Have not participated in a cult organization, have not been subjected to criminal punishment, and have good conduct, fairness and decency;
3. Permanent residents aged between 28 and 65;
4. Have the physical conditions to perform their duties normally;
5. Law-abiding, good conduct, fair and decent;
6. The location of the household registration or the location of the work unit is within the jurisdiction of Shangsi County Judicial Bureau;
7. Have a high school education or above;
8. Can guarantee to participate in trial activities on time.
(2) The following persons cannot serve as people’s jurors:
1. Members of the Standing Committee of the People’s Congress, staff of the supervisory committee, people’s courts, people’s procuratorates, public security organs, state security organs and judicial administrative organs;
2. Lawyers, notaries, arbitrators and grassroots legal service workers;
3. Other persons who are not suitable to serve as people’s jurors due to their positions.
(3) No one may serve as a people’s juror under any of the following circumstances:
1. Having received criminal punishment;
2. Being expelled from public office;
3. The practicing certificate of a lawyer or notary has been revoked;
4. Being included in the list of people who have lost their trust;
5. Being removed from the post of people’s jury due to punishment;
6 other serious violations of law and discipline, which may affect the judicial public trust.
(4) Other requirements:
1. The term of office of a people’s jury is five years, and it is generally not allowed to be re-elected. Citizens shall not serve as people’s jurors for more than two times.
2. A citizen may not serve as a people’s juror in more than two basic people’s courts at the same time.
Third, the treatment guarantee
People’s jurors participate in judicial activities according to law and are protected by law. Shangsi County People’s Court guarantees all expenses necessary for people’s jurors to perform their duties, and pays people’s jurors the living allowance, transportation allowance and dining allowance they should enjoy when performing their duties.
Where a people’s juror in a work unit has been deducted or deducted wages, bonuses and other welfare benefits in disguised form by his unit for participating in training and trial activities, the county judicial bureau shall, jointly with the county people’s court, put forward rectification opinions to his unit or the competent department of his unit.
Fourth, the selection process
(1) Selection of candidates. Through random selection, individual application and organization recommendation, the selection is carried out.
1. Random selection. County Public Security Bureau, grass-roots police stations, together with county judicial bureau, grass-roots judicial offices, county people’s courts and grass-roots people’s courts, randomly select from the list of permanent residents within their jurisdiction.
2. Organize recommendation. Citizens who meet the requirements of serving as people’s jurors shall, after obtaining their consent, submit the recommended materials to the judicial office under their jurisdiction (or to the Office of the Basic Comprehensive Unit of the County Judicial Bureau 206), and the units and grass-roots organizations shall issue preliminary examination opinions and fill in the Registration Form of People’s Juror Candidates.
3. Personal application. Citizens who meet the requirements of serving as people’s jurors directly submit a written application to the judicial office where their household registration is located or where they often live (or to the Office of Basic Comprehensive Unit of County Judicial Bureau 206), and fill in the Registration Form of People’s Juror Candidates.
(2) Qualification examination. The people’s jury candidates randomly selected, personally applied and recommended by the organization shall be examined by the county judicial bureau in conjunction with the county people’s court and the county public security bureau in accordance with the provisions of Articles 5, 6, 7 and 13 of the People’s Jury Law of People’s Republic of China (PRC) and solicit opinions from the randomly selected people’s jury candidates.
(3) determine the candidate. From the list of candidates for people’s jurors who have passed the qualification examination and agreed to serve as people’s jurors, the candidates for people’s jurors are randomly selected.
(4) publicity before appointment. Publicize the list of people’s jurors to be appointed to the society.
(5) Submitting for appointment. The candidates for the people’s jurors determined after publicity shall be submitted by the president of the county people’s court to the Standing Committee of the county people’s Congress for appointment.
(6) oath of office. After the appointment of the Standing Committee of the People’s Congress is approved, the people’s jurors hold an oath of office in public.
V. Registration procedures for individual applications and organizational recommendations
1. Registration time: from the date of announcement to November 20, 2020.
2. Registration materials: (1) The paper version of the People’s Juror Candidate Registration Form is in triplicate (double-sided printing), and the electronic version is sent to shsxsfj@163.com, the mailbox of Shangsi County Judicial Bureau; (2) I recently took a photo of a small 2-inch photo bareheaded, and the original and photocopy of identification materials such as citizen ID card and household registration book, as well as the original and photocopy of academic certificate. (3) The People’s Juror Candidate Registration Form is provided by the town (street) judicial office (including the electronic form) or collected (copied) from the Office of the Basic Comprehensive Unit of the County Judicial Bureau, or downloaded from Shangsi County People’s Court website and Shangsi County People’s Court WeChat WeChat official account.
People’s jurors participate in the trial activities of the people’s courts on behalf of the people and have the same powers as judges, which is not only the concrete embodiment of the people’s right to be masters of their own affairs, but also a glorious duty and obligation.
